According to the Plastics Act, the last user is subject to an additional product fee. The product price does not include the product fee, and the obligation to pay the product fee and keep records rests with the entrepreneur making the purchase at this auction. Below is information on the rates and obligations of the entrepreneur.
On December 11, 2023, the fee rates for the Act were published.
PLN 0.20/pc. beverage cups, including their lids and covers;
PLN 0.25/pc. for ready-to-eat food containers defined in the Act.
Introducing the obligations arising from the implementation of the SUP Directive into Polish law is a challenge due to the diversity of products present in companies. The multitude of industries and products made this process more complex than originally anticipated. Companies faced the considerable task of adapting to the new regulations. From restaurants to grocery stores, from hotels to catering companies every industry must adapt to the new regulations.
Beyond the scope of the changes, the timetable according to which the individual provisions of the directive come into force is extremely important for every entrepreneur.
May 24, 2023 from this date, the EU Single-Use Plastics Directive comes into force in Poland. From this date, entrepreneurs who place on the market or make available single-use products made of plastics, including packaging products, should adapt their operations to the directive.
August 24, 2023 the final deadline by which entrepreneurs operating a catering facility or retail unit who have not yet registered with the BDO must register. Entrepreneurs who run a catering business and are already in the register must submit an appropriate update application.
January 1, 2024 from this date, entrepreneurs who run retail outlets, catering facilities or those who use vending machines should charge a fee for the disposable plastic packaging they provide.
March 15, 2024 deadline for submitting the first annual report to the BDO for single-use plastic products placed on the market or made available, including packaging products. The report covers the year 2023.
July 1, 2024 - from this date, trade and catering are obliged to provide customers with alternative versions of disposable products made of plastic, including packaging products.
March 15, 2025 - the first product fee paid by trade and catering for additional fees collected from end users related to the provision of packaging and disposable plastic products.
Penalties for failure by entrepreneurs to comply with the obligations imposed on them by the Act
PLN 500 to PLN 20,000 - this is the amount that an entrepreneur who does not charge fees for plastic beverage cups and food containers will pay; this penalty also applies to entrepreneurs who do not provide an alternative to disposable packaging made of plastic from July 1, 2024; this applies to both catering establishments and vending devices (e.g. coffee, tea machines, etc.);
PLN 10,000 PLN 100,000 this is how much an entrepreneur will pay if he does not keep appropriate records of disposable plastic products and packaging products placed on the market,
PLN 10,000 PLN 500,000 this is how much an entrepreneur will pay if he places banned plastic products or oxo-degradable products on the market; A fine of the same amount will also be paid by entrepreneurs who fail to timely finance Public Educational Campaigns.
